It is understood the cop believed Mr Kaba was about to run him down in Streatham, South London last September.
The officer, codenamed NX121, is suspended from duty and was probed for alleged murder.
Yesterday the case was referred to the Crown Prosecution Service by the police watchdog.
Independent Office for Police Conduct director Amanda Rowe said: “A referral to the CPS does not necessarily mean criminal charges follow.”
Mr Kaba’s family welcomed the decision, and “very much hope” the officer faces prosecution.

Bizarre moment ZEBRA charges through the streets of Seoul after escaping from zoo
THIS is the bizarre moment a zebra charges through the streets of Seoul after escaping from a zoo.
The stripy animal cut loose from Seoul Children’s Grand Park Zoo, South Korea, on Thursday.
The male zebra, named Sero, then went on a three-hour jaunt before local authorities were able to catch up with him.
Hilarious footage of the two-year-old escapist trotting through the capital city was filmed by local bystanders.
At one point the African horse picked up some serious pace as it headed for a major road.
Other clips even captured the moment Sero poked his nose into residents’ garbage bins in the city’s east.
According to zoo officials, the zebra busted out at around 2.50pm after he destroyed the wooden fencing lining his pen.
A few hours later, police and emergency services were able to locate the animal and trap it.
Sero was shot with tranquilizers and returned to the zoo.
There have been no reports of injuries or property damage as a result of the incident.
A Children’s Grand Park Zoo spokesman told the Associated Press the zebra has been assessed by vets and is in a stable condition.

Prosecutors have told the media that they will seek Kwon’s extradition.
The charges follow his apparent arrest in Montenegro on Thursday, which was first reported through social media posts by Montenegro Minister of the Interior Filip Adzic on Twitter (where he’s unverified, whether by Twitter Blue or legacy means), and on Facebook (where he is verified, but Facebook’s blue checks have been wrong…
Coinbase Warned By SEC of Potential Securities Charges
Coinbase described the investigation as “cursory,” and said the Wells notice provided relatively little information about potential violations. “Although we don’t take this development lightly, we are very confident in the way we run our business — the same business we presented to the SEC in order for us to become a public company in 2021,” Coinbase Chief Legal Officer Paul Grewal said in a blog post. The company said that until the resolution of any legal processes, the exchange’s offerings would continue to operate as usual.
