Apple wins appeal against UK antitrust probe into mobile browser dominance
Apple has handed the UK’s Competition and Markets Authority a major setback in its effort to regulate the tech giant. On Friday, the company won an appeal against an investigation the antitrust watchdog launched last fall. As a refresher, the CMA opened a full market probe into Apple and Google in November. At the time, the regulator said that many UK businesses felt restricted by the “stranglehold” the two tech giants had on mobile browsing. The probe also sought to determine if Apple was restricting the cloud gaming market through its App Store rules.
Per Reuters, Apple successfully argued the regulator had “no power” to investigate its position in the mobile browser market. The company said the CMA should have opened the probe at the same time it first published its report on mobile ecosystems last June. The Competition Appeal Tribunal (CAT), the court that oversees CMA cases, agreed with Apple, saying the regulator gave notice of its investigation too late.
Apple said it was “pleased” with the CAT’s decision, adding it would “continue working to deliver support for developers and a safe and secure experience for users.” Naturally, the CMA was less thrilled with the case’s outcome.
“We are disappointed with today’s judgment. We made this market investigation reference to make sure that UK consumers get a better choice of mobile internet services and that UK developers can invest in innovative new apps. Our concerns, and the reasons why we launched our market investigation, were not challenged by Apple,” the regulator said in a statement. “Given the importance of today’s judgment, we will be considering our options including seeking permission to appeal.”

I’m starting this with a personal story. My mother was a New York City public school teacher for many years. When she joined the school system, part of the deal was that, when she retired, many of the costs of her traditional Medicare plans would be subsidized by her union and by the city. So far, so good. However, now the city, in order to save money, is moving all its retirees, including the public school teachers, to a Medicare Advantage plan.
(If you don’t know what Medicare is, or the difference between traditional Medicare and Medicare Advantage, don’t worry about it — a lot of people don’t. I’ll explain in a moment.)

In January it was revealed Meghan and Prince Harry could be dragged into a Florida court over the matter.
However, a judge has now ruled in the Duchess’ favour – dismissing Samantha’s claims.
Meghan’s sister alleged the Duchess “falsely and maliciously” said that she was “an only child” during her and Prince Harry’s bombshell 2021 interview with Oprah Winfrey.
Her claim stated that Meghan made “demonstrably false and malicious statements” to an audience of “roughly 50 million people in 17 countries”.
The claim added that the Duchess “disseminated false and malicious lies” and “orchestrated the campaign to defame and destroy her sister’s and her father’s reputation”
This was allegedly done to subject Samantha to “humiliation, shame and hatred on a worldwide scale” and “promote the false ‘rags-to-royalty’ narrative” of the controversial couple.
Samantha also claimed that the book Finding Freedom: Harry and Meghan and the Making of a Modern Royal Family included “false statements” about her.
However, the judge did not rule in favour of Samantha, who suffers from multiple sclerosis and uses a wheelchair.
United States District Judge Charlene Edwards Honeywell said the claims around Finding Freedom were dismissed as Samantha could not prove that Meghan had a say in what went into the book.
Ms Honeywell also dismissed the claims regarding Meghan’s Oprah interview, but said Samantha had “one final opportunity” to amend her complaint.
The sister has 14 days to do so.

Apple Wins Appeals Battle in Ongoing Patent Infringement War With VirnetX, Could Save $502.8 Million
The U.S. Court of Appeals for the Federal Court on Thursday confirmed a ruling by the U.S. Patent and Trademark Office invalidating a pair of patents that VirnetX used in its patent infringement lawsuit against Apple, according to Reuters.
Apple in 2020 was ordered to pay VirnetX $503 million for infringing on VPN patents owned by VirnetX with the iPhone‘s VPN on demand feature. The two patents that have been invalidated were involved in that lawsuit, and now Apple might get the entire judgment vacated.
Apple appealed the $502.8 million award verdict after it was rendered, with both Apple and VirnetX presenting arguments in the appeal back in September. VirnetX attorney Jeff Lamken said at the time that if the court ultimately sided with the USPTO and invalidated the patents in the patent validity case, VirnetX could “have a big problem.” He said that he did not think VirnetX would have an “enforceable judgment” in that situation, so this is potentially a major win for Apple.
With the patents now invalidated, VirnetX and Apple will again meet in court over the initial appeals case that Apple filed to determine whether Apple will need to pay up, and it’s looking like the $502.8 million verdict will be thrown out.
Regardless of how this case plays out, Apple was forced to pay VirnetX $440 million for violating VirnetX’s communications security patents with the FaceTime and iMessage features.
VirnetX is largely viewed a patent holding company or “patent troll” that does not offer actual products or services. It generates revenue by litigating technology companies that infringe on its patents, though it does also market its “War Room” software for authenticated meetings.
