NTSB: Autopilot was not a factor in fatal Tesla Model S crash
Tesla’s Autopilot was not at fault in a 2021 crash in which two people died, according to the National Transportation Safety Board (NTSB). In a final report spotted by Ars Technica, the agency determined that the 2019 Model S accelerated just before hitting a tree in Spring, Texas, just north of Houston. Neither occupant was in the driver’s seat when they were found, leading to questions about the use of Autopilot.
Based on information provided by Tesla, the NTSB found (PDF) that the car’s rapid acceleration from 39MPH to 67MPH two seconds before the crash and a loss of control of the EV was likely due to “impairment from alcohol intoxication in combination with the effects of two sedating antihistamines, resulting in a roadway departure, tree impact and post-crash fire.” The NTSB says data indicated that Autopilot had not been employed “at any time during this ownership period of the vehicle.” Investigators did not find any “evidence of mechanical deficiencies” that could have contributed to or caused the crash.
One of the occupants was found in the front passenger seat, while the other was in the rear. It’s presumed that the driver was in the back seat because he was trying to escape. Security footage showed that the men were in the front seats as they set off, while data showed that both front seatbelts were buckled at the time of the crash — the car left the road around 550 feet from the driver’s home. The men died as a result of the collision and post-crash battery fire.

NTSB Wants Alcohol Detection Systems Installed In All New Cars In US
Under a US law enacted last year, the NHTSA is already required to examine whether it can issue this type of rule. While drunk driving is a longstanding problem that has caused many deaths, the NTSB said its recommendation was spurred by its investigation into one crash that killed nine people — including seven children — in January 2021 on State Route 33 near Avenal, California. Section 24220 of the Bipartisan Infrastructure LawSection 30111 of Title 49 in US law, it can delay issuing a rule for three years and submit annual reports to Congress describing the reasons for not issuing the rule. Each annual report would also have to contain an update on “the deployment of advanced drunk and impaired driving prevention technology in vehicles.” In writing the law, Congress noted that “in 2019, there were 10,142 alcohol-impaired driving fatalities in the United States involving drivers with a blood alcohol concentration level of .08 or higher, and 68 percent of the crashes that resulted in those fatalities involved a driver with a blood alcohol concentration level of .15 or higher.” Congress also cited a study by the Insurance Institute for Highway Safety estimating that “advanced drunk and impaired driving prevention technology can prevent more than 9,400 alcohol-impaired driving fatalities annually.”

NTSB calls for all new vehicles to include alcohol monitoring tech
The National Transportation Safety Board is calling on its sister agency to implement regulation requiring all vehicles sold in the US to include blood alcohol monitoring systems. The NTSB sent the recommendation to the National Highway Traffic Safety Administration on Tuesday after completing an investigation into a horrific collision last year that involved drunk driving and the death of two adults and seven children.
“Technology could’ve prevented this heartbreaking crash — just as it can prevent the tens of thousands of fatalities from impaired-driving and speeding-related crashes we see in the US annually,” said NTSB Chair Jennifer Homendy. “We need to implement the technologies we have right here, right now to save lives.”
According to statistics published by the NHTSA, nearly 43,000 people died on US roads last year, marking the highest that number had been in 16 years. While traffic deaths fell slightly between April and June, Ann Carlson, the agency’s acting administrator, said a “crisis” was still underway on the country’s roads. “We need NHTSA to act. We see the numbers,” Homendy told The Associated Press. “We need to make sure that we’re doing all we can to save lives.”
The NTSB says all new cars sold in the US should include an integrated system that passively detects if the driver is under the influence of alcohol. It notes that such a system could be combined with advanced driver monitoring technologies to prevent accidents. Separately, the agency recommends that the NHTSA incentivize automakers to include tech that prevents speeding-related collisions. The NTSB does not have the authority to regulate or enforce any safety measures it suggests. It has been calling on the NHTSA to explore alcohol monitoring technologies since 2012.
The NHTSA also faces pressure from Congress to mandate such systems. Under last year’s Bipartisan Infrastructure Law, the agency has three years to study the feasibility of various alcohol monitoring technologies and establish a final set of rules. It can seek an extension, however. And in the past, it has been slow to implement such requirements.
